These Terms of Service ("Terms") form a binding agreement between you ("you," "User") and ApeXhit LLC, a Florida limited liability company ("ApeXhit," "we," "us," or "our"), governing your access to and use of the ApeXhit FHB web application, progressive web app (PWA), and any related services (collectively, the "App"). By creating an account, installing the App, activating a license key, or otherwise using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Description of the App

ApeXhit FHB is a personal financial health and bookkeeping tool that lets you track income, expenses, investments, net worth, debt, and budgets; scan and store receipts; generate invoices; calculate estimated taxes and paycheck (gross/net) estimates; set payment reminders; track life insurance policies, retirement accounts, and college savings goals; receive educational account-type suggestions through the Tax Strategy Advisor; and export or sync your data across your own devices ("Family Sync"). A built-in Help & FAQ section and a Storage Usage tool are also provided to support your use of the App. The App offers a free "Lite" tier with limited entries and paid tiers (Pro, Family, Team, Enterprise, and Enterprise+) that unlock additional features and device seats, described further in Section 5.

2. Not Financial, Tax, Legal, or Accounting Advice

The App is a self-service organizational and estimation tool. Nothing in the App — including tax calculations, gross/net paycheck estimates, budget suggestions, debt payoff projections, financial health scores, life insurance and retirement account tax-treatment summaries, college cost projections, Tax Strategy Advisor recommendations, or AI support chat responses — constitutes financial, tax, legal, investment, insurance, or accounting advice. Tax bracket and flat-rate estimates are approximations for planning purposes only and may not reflect your actual liability. Account-type comparisons and rankings shown in features like the Tax Strategy Advisor and College Planning Calculator are general educational information based on the answers/inputs you provide — they are not a personalized recommendation and do not account for your complete financial picture. You are solely responsible for verifying all calculations and consulting a licensed professional (CPA, tax preparer, financial advisor, insurance agent, or attorney) before making financial, tax, insurance, or investment decisions. ApeXhit is not a registered investment advisor, insurance agency, tax preparer, or accounting firm, and using the App does not create an advisory or fiduciary relationship of any kind.

3. Eligibility & Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the App. The App is intended for personal, household, or small-business bookkeeping and is not directed at children under 13. Some data (license keys, entries, preferences) may be stored locally in your device's browser storage rather than tied to a traditional account; you are responsible for safeguarding any device, browser profile, or license key associated with your use of the App.

4. Your Financial Data

You retain all ownership rights to the financial data, receipts, invoices, and other content you enter or upload into the App ("Your Data"). You grant ApeXhit a limited license to store, process, and transmit Your Data solely to operate, maintain, and improve the App and to provide features you request (e.g., Family Sync merging backups across your devices, receipt image storage, JSON data backups). See our Privacy Policy for full details on data handling.

You are solely responsible for the accuracy of Your Data and for maintaining independent backups. ApeXhit provides backup and export tools, but is not liable for data loss resulting from device failure, browser storage clearing, uninstallation, storage capacity limits, or your failure to export/back up Your Data.

Because the App stores Your Data locally in your browser, it is subject to your browser's storage capacity (typically a few megabytes per site). The App includes a Storage Usage tool and automatic image compression for receipt photos to help manage this, and is designed to warn you rather than lose data silently if capacity is reached — but you remain responsible for monitoring your usage, exporting backups regularly, and removing data you no longer need (e.g., old receipt photos) if you approach your device's storage limits.

5. Subscriptions, Tiers & License Keys

Paid tiers are billed on a recurring subscription basis (monthly, unless otherwise stated at checkout) through our payment processor, Lemon Squeezy, acting as merchant of record. By subscribing, you authorize Lemon Squeezy to charge your chosen payment method on a recurring basis until you cancel. Each subscription includes a license key with a defined device activation limit (Pro: 1 device, Family: 6, Team: 14, Enterprise: 50, Enterprise+: unlimited). Activating a key on more devices than your tier permits may be blocked or require deactivating another device first.

You may cancel your subscription at any time through your Lemon Squeezy customer portal or by contacting us at apexhit01@gmail.com. Cancellation stops future renewals; it does not automatically entitle you to a refund for the current billing period except as described in our Refund Policy. Lite-tier features remain available indefinitely at no charge, subject to entry limits.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose, including money laundering, tax evasion, or fraud;
• Reverse-engineer, decompile, or attempt to extract source code from the App, except to the extent applicable law expressly permits;
• Circumvent, disable, or attempt to bypass license key activation limits, tier gating, or entry-limit restrictions;
• Resell, sublicense, or redistribute the App or license keys without our written consent;
• Upload malicious code, or use the App to store data belonging to third parties without their consent (e.g., scanning receipts or invoices containing another person's personal data without authorization);
• Interfere with or disrupt the App's infrastructure, including automated scraping or excessive API calls.

7. Third-Party Services

The App integrates third-party services including Lemon Squeezy (payments and license management), cloud hosting/CDN providers, and may integrate email delivery for reminders. Your use of those integrations is also subject to the respective third party's terms and privacy policies. We are not responsible for the acts or omissions of independent third-party providers.

8. Intellectual Property

The App, including its design, branding ("ApeXhit," "ApeXhit FHB," the FHT Shield logo), source code, and content (excluding Your Data), is owned by ApeXhit LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended personal or business bookkeeping purpose, subject to these Terms and the EULA.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED/ERROR-FREE OPERATION. We do not warrant that calculations, tax estimates, or financial health scores are accurate, complete, or suitable for your specific situation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APEXHIT LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR FINANCIAL LOSSES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

11. Indemnification

You agree to indemnify and hold harmless ApeXhit LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the App, or Your Data, including any third-party data you upload without authorization.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms, suspected fraud, or abuse of license activation limits. You may stop using the App at any time. Upon termination, your right to use paid features ceases, though you remain responsible for any charges already incurred.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising from these Terms or the App shall be resolved exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction there. To the extent permitted by law, you and ApeXhit each waive the right to a jury trial and to participate in a class action.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
